These Terms & Conditions (“Terms”) govern your access to and use of the CinchFlow website and any related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
1) Who we are
“CinchFlow,” “we,” “us,” and “our” refers to the operator of the Service.

2) What CinchFlow provides
CinchFlow provides a human-backed automation service that helps process inbound requests and operational tasks. The Service may include:
- automation (including AI-assisted routing, drafting, summarization, and task creation), and
- human services performed by CinchFlow staff (including follow-up calls, bookings, data entry, and invoice follow-up),
based on your configuration, instructions, and boundaries.
3) Eligibility and authority
You represent that you are able to form a binding contract and, if you are using the Service for a business or entity, you have authority to bind that entity.
4) Accounts and security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to promptly notify us of any suspected unauthorized access.
5) Your instructions and permitted actions
You authorize CinchFlow to act on your behalf only as needed to provide the Service (for example: contacting customers/vendors, scheduling, updating records, and following up on invoices), in accordance with:
- your written configuration, policies, and scripts (where provided), and
- any boundaries, approval rules, or “do not do” instructions you set.
You are responsible for ensuring you have the right to authorize CinchFlow to contact third parties and process any data you provide or connect.
6) Customer Data
You retain ownership of content and data you provide or connect to the Service (“Customer Data”). You grant CinchFlow a limited right to access, use, process, and transmit Customer Data solely to:
- provide and maintain the Service,
- perform the tasks and follow-through you request,
- provide support and troubleshoot issues, and
- comply with legal obligations.
7) Acceptable use
You agree not to use the Service to:
- violate any law or third-party rights,
- send unlawful, misleading, harassing, or abusive communications,
- distribute malware or attempt unauthorized access,
- interfere with the integrity or performance of the Service.
We may suspend or terminate access if we reasonably believe you violated these Terms or if required by law.
8) Third-party services and integrations
The Service may connect to third-party products and services (e.g., email, messaging, calendars, CRMs, task tools, automation tools, communications providers, accounting/payment platforms). Your use of those services is governed by their terms. CinchFlow is not responsible for third-party outages, failures, or changes.
9) Fees and billing
Fees and billing terms are described on your order form, proposal, or pricing page. Unless otherwise stated, fees are billed in advance and are non-refundable except where required by law. Taxes may apply.
10) Call recording (support and quality)
We may record calls for customer support, quality assurance, training, and recordkeeping. By calling or participating in a call with CinchFlow, you consent to such recording where permitted by law.
If you prefer not to be recorded, contact us at support [at] cinchflow [dot] com and we will provide an alternative support channel where feasible.
11) Confidentiality
Each party may receive non-public information from the other. Each party agrees to protect the other’s confidential information and use it only to perform obligations under these Terms.
12) Disclaimers
The Service may include AI-assisted outputs. You are responsible for setting approval rules and boundaries appropriate for your business. To the maximum extent permitted by law, the Service is provided “as is” and “as available,” and CinchFlow disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
13) Limitation of liability
To the maximum extent permitted by law, CinchFlow will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data.
To the maximum extent permitted by law, CinchFlow’s total liability for any claim arising out of or relating to the Service is limited to the fees you paid to CinchFlow in the three (3) months prior to the event giving rise to the claim.
14) Indemnity
You agree to indemnify and hold CinchFlow harmless from claims, damages, and expenses arising from:
- your misuse of the Service,
- your Customer Data, scripts, instructions, or policies,
- your communications with third parties, or
- your violation of any law or third-party rights.
15) Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or if required by law. Upon termination, access will end and we may delete or return data in accordance with our Privacy Policy and your configuration.
16) Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
